ImpairmentIQPro Terms of Service

Effective Date: August 27, 2026 · Version 2026-08-27

These Terms of Service ("Terms") govern access to and use of ImpairmentIQPro, including its website, software, artificial-intelligence-assisted analysis tools, reports, and related services (collectively, the "Service").

By creating an account, purchasing a subscription, accessing the Service, or otherwise using ImpairmentIQPro, you ("User," "you," or "your") agree to these Terms.

If you do not agree to these Terms, you may not use the Service.

1. Description of the Service

ImpairmentIQPro is a software platform providing AI-assisted analysis of impaired-driving and related case materials.

The Service may analyze information including police reports, investigative records, standardized field sobriety testing, drug recognition evaluation information, chemical testing, reported impairment indicators, evidentiary issues, legal and scientific reference materials, and other case-related information.

The Service may generate case summaries, analytical observations, identification of potential strengths or weaknesses, evidentiary gaps, research information, suggested areas for further investigation or review, and downloadable reports.

2. Not Legal Advice or Expert Opinion

ImpairmentIQPro is an analytical and research-assistance tool.

ImpairmentIQPro is not a law firm and does not provide legal advice, legal representation, medical advice, or professional expert testimony.

Use of the Service does not create an attorney-client, expert-client, fiduciary, or other professional relationship between ImpairmentIQPro and any User or person whose information is analyzed.

AI-generated information may contain errors, omissions, outdated information, incomplete analysis, or inaccurate conclusions.

Users are responsible for independently reviewing and verifying all information produced by the Service before relying upon it in connection with any legal proceeding, investigation, professional decision, client advice, court filing, negotiation, or other matter.

No output should be treated as a substitute for the independent professional judgment of a licensed attorney, qualified expert, medical professional, law-enforcement professional, or other appropriate professional.

3. No Guarantee of Case Outcomes

ImpairmentIQPro does not predict or guarantee the outcome of any criminal, civil, administrative, or other legal proceeding.

Historical case outcomes, statistical information, similarities to previous matters, or other information presented by the Service are provided for informational and analytical purposes only.

Past outcomes do not guarantee or predict future results.

4. Eligibility

You must be at least 18 years old to use ImpairmentIQPro.

The Service may be used by attorneys, legal professionals, investigators, law-enforcement professionals, consultants, educators, researchers, and other authorized users.

You represent that your use of the Service complies with all laws, professional obligations, confidentiality requirements, court orders, employment obligations, and contractual restrictions applicable to you.

5. User Accounts

You are responsible for maintaining the confidentiality and security of your account credentials.

You may not knowingly permit unauthorized individuals to access your account.

You are responsible for activity conducted through your account and agree to promptly notify ImpairmentIQPro at support@impairmentiqpro.com if you believe your account has been compromised.

6. Authority to Upload Case Materials

You are solely responsible for determining whether you are legally and professionally authorized to upload information to ImpairmentIQPro.

By uploading documents or information, you represent that you have the legal authority, permission, or other lawful basis necessary to provide the materials to the Service for processing.

You must not upload information when doing so would violate applicable law, a court order, a protective order, professional obligations, confidentiality requirements, contractual restrictions, or the rights of another person.

7. Sensitive Case Information

Case materials may contain sensitive or confidential information, including personal identifying information, medical information, driver's-license information, chemical testing information, criminal justice information, and other case-related data.

Users should upload only information reasonably necessary for the analysis being requested.

ImpairmentIQPro will use reasonable administrative, technical, and organizational safeguards designed to protect information processed through the Service. However, no electronic system can guarantee absolute security.

8. Artificial Intelligence Processing

ImpairmentIQPro uses artificial intelligence and automated systems as part of its analysis.

Before case text is transmitted to a third-party AI provider, ImpairmentIQPro runs an automated process designed to remove or replace supported categories of identifying information, as described in the Privacy Policy. This automated process is not guaranteed to remove all identifying information, and remaining case context may still identify an individual.

The scrubbed analysis content may be transmitted to third-party AI providers (currently OpenAI and Anthropic) acting as service providers when necessary to generate an analysis or otherwise operate the Service. Those providers' data practices are governed by their own terms and by our agreements and configuration with them; ImpairmentIQPro does not represent that any provider operates under a zero-data-retention arrangement or a HIPAA Business Associate Agreement.

The use of AI inherently involves limitations. Outputs may be incomplete, inaccurate, inconsistent, or incorrect. Users must independently evaluate outputs before relying upon them.

9. User Case Storage and Deletion

When you submit a case, the submitted text is stored as part of the processing and account record for that analysis regardless of your storage setting. Separately, when case-data storage is enabled for your account, completed reports are saved to your report history. Case-data storage is enabled by default and can be turned off in Settings; turning it off stops future reports from being saved to your history but does not delete previously saved reports or the processing records.

Users may delete saved reports through available account functionality or may request deletion of other case information by contacting support@impairmentiqpro.com.

Certain information may temporarily remain in backups, security systems, transaction records, or other systems where retention is reasonably necessary for legal, security, fraud-prevention, dispute-resolution, or technical purposes.

10. De-Identified and Anonymized Information

ImpairmentIQPro may create and retain de-identified, anonymized, and/or aggregated information derived from use of the Service.

Such information may be used to improve the Service, evaluate system performance, develop research or analytical features, and provide historical case or outcome information.

ImpairmentIQPro will not intentionally include information in such datasets that directly identifies a User, client, defendant, witness, officer, victim, or other individual.

Once information has been appropriately de-identified or anonymized so that it is no longer reasonably associated with an identifiable individual, ImpairmentIQPro may retain and use that information as permitted by applicable law.

11. Historical Outcome Information

The Service may provide historical information concerning outcomes from previous matters, including information organized by jurisdiction, case characteristics, or other relevant factors.

Such information is intended to provide historical context only.

It does not constitute a prediction, guarantee, recommendation regarding case disposition, or statement regarding what will occur in any particular matter.

12. Subscription and Billing

Access to ImpairmentIQPro may require a paid subscription.

The current subscription price and applicable billing terms will be disclosed at the time of purchase.

Unless otherwise stated at checkout, subscriptions automatically renew at the applicable subscription rate until canceled.

By purchasing a recurring subscription, you authorize ImpairmentIQPro and its payment processor to charge your selected payment method for recurring subscription fees and applicable taxes.

ImpairmentIQPro may change subscription pricing upon reasonable advance notice. Pricing changes will apply prospectively and will not retroactively alter charges already paid.

13. Cancellation

Users may cancel their subscription at any time through available account or billing functionality or by contacting support@impairmentiqpro.com.

Unless otherwise stated, cancellation prevents the subscription from renewing for the next billing period. The User will generally retain access through the end of the already-paid billing period.

14. Refunds

Except where required by applicable law, subscription payments and other fees paid to ImpairmentIQPro are non-refundable.

Cancellation does not entitle the User to a refund or prorated credit for any unused portion of the current billing period.

ImpairmentIQPro may issue refunds or credits in its discretion under exceptional circumstances, but doing so does not create an obligation to provide similar refunds or credits in the future.

15. Prohibited Uses

Users may not use ImpairmentIQPro to:

  • Violate applicable law or the legal rights of another person;
  • Upload information they are not authorized to possess, disclose, or process;
  • Gain unauthorized access to another person's account or data;
  • Circumvent security or access controls;
  • Reverse engineer, scrape, copy, reproduce, or systematically extract proprietary portions of the Service except as permitted by law;
  • Interfere with the operation or security of the Service;
  • Introduce malicious software or code;
  • Resell, sublicense, or commercially redistribute access to the Service without authorization; or
  • Represent AI-generated analysis as a guaranteed professional or expert conclusion.

16. Intellectual Property

ImpairmentIQPro and its software, design, databases, analytical frameworks, branding, interfaces, and proprietary materials are owned by ImpairmentIQPro or its licensors and are protected by applicable intellectual-property laws.

Users retain their rights in materials they lawfully upload.

Subject to these Terms, Users may use reports generated for them through the Service for their own lawful professional, business, educational, research, or personal purposes.

17. Availability and Modifications

ImpairmentIQPro does not guarantee uninterrupted or error-free availability.

The Service may occasionally be unavailable because of maintenance, updates, third-party provider outages, technical failures, security concerns, or circumstances outside ImpairmentIQPro's reasonable control.

ImpairmentIQPro may modify, add, or remove features as the Service evolves.

18. Suspension or Termination

ImpairmentIQPro may suspend or terminate access when reasonably necessary because of suspected fraud, security concerns, unlawful activity, violation of these Terms, nonpayment, abuse of the Service, or conduct that threatens the Service or other Users.

Users may discontinue use of the Service and cancel their subscriptions at any time.

19. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."

IMPAIRMENTIQPRO DISCLAIMS WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, AND RELIABILITY TO THE EXTENT PERMITTED BY LAW.

IMPAIRMENTIQPRO DOES NOT WARRANT THAT ANY ANALYSIS, REPORT, RESEARCH RESULT, LEGAL AUTHORITY, SCIENTIFIC INFORMATION, OR AI-GENERATED OUTPUT WILL BE COMPLETE, CURRENT, ERROR-FREE, OR SUITABLE FOR A PARTICULAR CASE.

20. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IMPAIRMENTIQPRO AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO USE OF THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IMPAIRMENTIQPRO'S AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT PAID BY THE USER TO IMPAIRMENTIQPRO DURING THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Nothing in these Terms excludes liability that cannot lawfully be excluded.

21. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless ImpairmentIQPro and its owners, officers, employees, and contractors from claims, damages, liabilities, losses, and reasonable expenses arising from your unlawful use of the Service, your violation of these Terms, or your unauthorized submission of third-party information.

22. Governing Law and Venue

These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles.

Subject to any rights that cannot legally be waived, disputes arising from or relating to these Terms or the Service will be brought in an appropriate state or federal court located in Cook County, Illinois, and the parties consent to jurisdiction and venue there.

23. Changes to These Terms

ImpairmentIQPro may update these Terms periodically.

When material changes are made, ImpairmentIQPro may provide notice through the Service, by email, or through another reasonable method.

Continued use of the Service following the effective date of updated Terms constitutes acceptance to the extent permitted by law.
